Membership Agreement

Parties: The user creating an account on the Site (the “Member”) and the Site operator.

1. Definitions and Scope

This Membership Agreement (the “Agreement”) governs the Member’s account creation and use of the Site and the services offered through it. By creating an account, you accept this Agreement as well as the Privacy Policy and Cookie Policy (incorporated by reference). If you do not agree, please do not register.

2. Eligibility

• Age & Capacity: You must be at least 18 and have legal capacity under applicable law to enter into contracts. Users under 18 may not register without consent of a legal guardian.
• Accurate & Current Information: You are responsible for providing accurate, complete, and up-to-date information during registration and thereafter. Inaccurate or incomplete information may lead to termination.
• Single Account: Each natural or legal person may register one account only.
• Acceptance: By ticking “I have read and accept the Agreement” you consent to be bound by these terms.

3. Account & Security

• Confidentiality: You must keep your username, password, and session credentials confidential.
• Notice: Notify the Site immediately of any unauthorized use or security breach.
• Liability: The Site is not liable for unauthorized activities resulting from the Member’s fault.

4. Member Rights

• Account Management: Access and update your profile and contact details.
• Order Tracking: View the status of orders placed via the Site.
• Special Offers: Receive campaigns and promotions (marketing communications only with explicit consent).
• Deletion: You may permanently delete your account or terminate your membership at any time.

5. Member Obligations & Prohibited Conduct

The following are strictly prohibited:

• Unlawful Activity: Any illegal content/activity, distribution of pirated software, incitement to crime.
• Abuse: Spam, phishing, malware distribution, interference with the Site infrastructure.
• IP Infringement: Content that violates third-party copyrights, trademarks, or other IP rights.
• Account Sharing: Sharing your account or accessing others’ accounts without permission.
• Automation & Scraping: Data scraping, use of bots/spiders/scrapers, or unauthorized API access.
• Fraud: False identities, misrepresentations, or maintaining multiple accounts.

6. Suspension & Termination

• By Member: You may terminate your membership at any time via account settings.
• By Site: The Site may suspend or terminate membership (with notice, or without notice in exceptional circumstances) for breach, security risk, or legal obligation.
• Effect: Termination does not affect rights or obligations that by their nature survive. Personal data matters are governed by the Privacy Policy.

7. Personal Data & Privacy

Your personal data are processed in compliance with applicable laws, including KVKK and GDPR. See the Privacy Policy for details.

8. Electronic Communications

Marketing communications are sent only with your explicit consent. You may withdraw consent at any time (withdrawal does not affect the lawfulness of prior processing).

9. Changes to this Agreement

The Site may update this Agreement at any time. Changes take effect upon publication on the Site. Continuing your membership constitutes acceptance.

10. Governing Law & Dispute Resolution

Parties shall first seek an amicable resolution. Unresolved disputes are governed by Polish law and subject to the jurisdiction of competent courts in Uganda (mandatory consumer protections remain unaffected).

12. Miscellaneous

Severability, no waiver, and assignability principles apply. In case of discrepancies between language versions, the most recently published version on the Site prevails.
